List & Story is a Listing Copy & Content Studio providing writing, creative content, messaging, and related marketing support for real estate professionals.
The founder of List & Story maintains a current Florida real estate license; however, she does not currently practice real estate, operate as a real estate agent through List & Story, or provide brokerage services through this business.
She is not currently affiliated with or operating under a real estate brokerage and is not currently a member of a real estate trade association.
List & Story does not represent buyers or sellers, negotiate real estate transactions, provide brokerage services, or create an agency, fiduciary, brokerage, or representation relationship with a client or the client’s customers.
Any real estate license held by the founder is separate from the services provided by List & Story.
02Introductory Consultation
An introductory consultation is required before your first project begins.
This conversation gives us an opportunity to understand how you work, discuss the property and requested services, confirm project details and expectations, establish timelines, and finalize scheduling and payment.
After your introductory project, future listings may not require another consultation unless the scope, circumstances, or requested services make one necessary.
A consultation does not reserve production time unless otherwise confirmed by List & Story.
03Payment
Payment is required in full before services are rendered.
Work will not begin until:
- The applicable project details have been finalized.
- Any required consultation has been completed.
- Requested materials have been received.
- Payment has been successfully processed.
Production dates and turnaround times are scheduled based on when these requirements are completed, not simply when an inquiry or initial request is submitted.
Additional services, expanded scope, rush requests, or work outside the originally agreed project may require additional payment before that work begins.
04What We Need From You
Good copy begins with good information.
Clients are responsible for providing accurate and reasonably complete property information, photographs, relevant listing details, required brokerage specifications, character limits, deadlines, and other materials requested by List & Story.
You agree to respond to reasonable requests for information, clarification, feedback, or approval promptly enough for us to keep your project moving.
If necessary information or approvals are delayed, your original delivery timeline may no longer be available.
Continued or substantial non-responsiveness may result in the project being paused, suspended, rescheduled, or terminated at List & Story’s discretion.
We cannot be responsible for missed launch dates or other delays caused by information, materials, approvals, or responses that were not provided when reasonably requested.
05Turnaround Times
Turnaround times begin only after the project is fully booked, payment has been received, and the materials necessary to begin have been provided.
Estimated turnaround times are provided in good faith but may be adjusted when requested information is incomplete, the client changes the scope, revisions materially change the original direction, client feedback is delayed, or circumstances outside List & Story’s reasonable control affect production.
Where offered, rush scheduling may be subject to availability and an additional fee.
06Property Information & Accuracy
List & Story writes from the property information, photographs, documents, notes, and representations supplied by the client.
We may help identify stronger ways to communicate those details, but we do not independently verify property facts.
The client remains responsible for confirming the accuracy of all information before publication, including but not limited to square footage, room counts, property features, improvements, community information, amenities, distances, pricing, school information, zoning, property condition, and other factual representations.
Nothing should be published simply because it was included in a draft from List & Story. Final review belongs to the client.
07Fair Housing, MLS & Brokerage Requirements
List & Story aims to create property-focused copy with Fair Housing considerations in mind.
However, clients remain responsible for ensuring that all final materials comply with applicable MLS rules, brokerage policies, advertising requirements, Fair Housing obligations, local regulations, and professional standards.
Because those requirements can differ by brokerage, MLS, location, and property type, final approval and publication remain the client’s responsibility.
08Revisions
The number of revisions included with a service will be stated in the applicable package or project agreement.
Revisions are intended to refine the agreed creative direction, not replace the original brief or substantially change the scope of the project.
Requests that introduce new information, substantially change direction, replace previously approved concepts, or require additional deliverables may be treated as additional work and priced separately.
09Client Review & Approval
You are responsible for reviewing completed materials before publishing, distributing, printing, posting, emailing, uploading, or otherwise using them.
Once you approve and publish a piece, you accept responsibility for its final content and use.
If you identify an error originating from List & Story, please notify us promptly so we can review it.
10Creative Judgment
Part of what you are hiring List & Story for is creative interpretation.
We may make editorial decisions regarding structure, tone, emphasis, storytelling angle, headlines, sequencing, and language based on the property information and direction you provide.
Creative preference is subjective. We cannot guarantee that every reader, seller, buyer, brokerage, or third party will respond to the work in the same way.
11Intellectual Property & Client Use
Once the applicable project has been paid in full, the client may use the final approved deliverables created specifically for that project for the marketing and promotion of the applicable property and their real estate business.
Drafts, unused concepts, internal working documents, processes, templates, methodologies, proprietary frameworks, and underlying List & Story systems remain the property of List & Story unless otherwise agreed in writing.
Clients may not resell, sublicense, package, or commercially redistribute List & Story materials as standalone products or templates.
12Portfolio Use
Unless confidentiality has been agreed to in writing beforehand, List & Story may display portions of completed work in its portfolio, website, social media, proposals, or promotional materials as examples of its creative work.
Sensitive or private client information will not intentionally be disclosed for portfolio purposes.
13Cancellations, Pauses & Termination
Because production time is reserved for each project, payments are not automatically refundable simply because a client changes plans after work has begun.
If a project must be canceled, paused, or rescheduled, List & Story will determine whether any credit, refund, or rescheduling accommodation is appropriate based on the work already completed and time reserved.
List & Story may suspend or terminate services when a client repeatedly fails to provide necessary information or responses, materially changes the agreed scope without approving additional work, fails to make required payments, requests unlawful, misleading, discriminatory, or unethical content, or otherwise makes continued performance unreasonable.
Termination does not eliminate amounts already owed for work performed or time reserved.
14No Guarantee of Results
Thoughtful copy and content can strengthen the way a property is presented, but real estate outcomes depend on many factors outside our control.
List & Story does not guarantee showings, inquiries, engagement, offers, contracts, sale price, days on market, lead generation, client acquisition, or a successful transaction.
Our responsibility is to provide the agreed creative services, not to guarantee a particular marketing or sales result.
15Limitation of Services
List & Story is a creative service provider.
Nothing we provide should be interpreted as legal advice, real estate brokerage advice, tax advice, financial advice, appraisal advice, inspection advice, or other professional advice outside the scope of our agreed creative services.
When appropriate, clients should consult their broker, attorney, accountant, MLS, association, or other qualified professional.
16Changes to These Terms
List & Story may update these Terms from time to time as its services evolve.
The version in effect when a project is booked will generally govern that engagement unless otherwise agreed in writing.
